Prepaid Hours of Service
1. What do both parties agree to do?
 
You have the authority to enter into this contract on behalf of yourself, your company or your organization. You’ll give us everything we need to complete the project when and in the format we need.
 
IT Mighty Web Design: IT Mighty Web Design will provide services for Recipient according to the description laid out in this proposal. Any additional features, pages, or other changes to project requirements may affect the timeline and costs laid out in the tables above and will require a separate change order document. Payment may be made by credit card paid online. We have the experience and ability to do everything we’ve agreed with you and we’ll do it all in a professional and timely manner. We’ll endeavor to meet every deadline that’s set and on top of that, we'll maintain the confidentiality of everything you give us.
2. Estimated Hours of Service
We create estimations as accurately as we are able to with the information that has been provided. Time estimates per task are subject to change when new task information is discovered. The tasks listed at the time of booking are in no way guaranteed to be completed. If the requested project tasks should exceed the estimated labor hours, a new proposal will need to be submitted in order to expand the budget of these implementations. We do provide itemized proposals upon request where tasks are guaranteed to be completed. These proposals are not offered for total order prices of under $1000 USD.
3. Hosting
 
We are not your website's host, nor do we provide website hosting services. We are not responsible for any issues arising through the fault of your website's host.
4. Design
 
We create look-and-feel designs, and flexible layouts that adapt to the capabilities of many devices and screen sizes. We create designs and share them online with you to have regular, possibly daily contact throughout the design process. If, at any stage, you’re not happy with the direction our work is taking, you agree that you will let us know in a timely manner so that we may better collaborate.
5. Text Content
 
We’re not responsible for writing any text content. Whenever text content is needed for your site, we will add placeholder text in place of actual text content. When text content is provided by Recipient we can import these items into your website. If you’d like us to write new content or input new text for you, we can provide a separate estimate for that.
6. Supply of Materials
 
You must supply all materials and information required by us to complete the work in accordance with any agreed specification. Such materials may include, but are not limited to, photographs, written copy, logos, text content, blog articles, product titles & descriptions, printed material and other related content. Where there is any delay in supplying these materials to us which leads to a delay in the completion of work, we have the right to extend any previously agreed deadlines by a reasonable amount. Where you fail to supply materials, and that prevents the progress of the work, we have the right to invoice you for any part or parts of the work already completed.
7. Project Delays & Client Liability
 
Any time frames or estimates that we give are contingent upon your full cooperation in a timely manner. During development there is a certain amount of feedback required in order to progress to subsequent phases. We may also need content from you such as photos, text copy, and other related materials. It is required that a single point of contact be appointed from your side and be made available on a daily basis in order to expedite the feedback and content gathering process.
8. Our Disclaimers
 
We can’t guarantee that our work will be error-free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised us of them. Finally, if any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforce-ability of any remaining provisions. Just like a parking ticket, you can’t transfer this contract to anyone else without our permission. This contract stays in place and need not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place.
9. Copyrights
 
First, you guarantee that all elements of text, images or other artwork you provide are either owned by your good selves, or that you’ve permission to use them. Then, when your final payment has cleared, copyright will be automatically assigned as follows: You own all elements of text, images, code, and data that we've created for you.
10. Our Fees & Deposits
 
We reserve the right not to commence any work until the deposit and/or remaining balance invoices have been paid in full. Prepaid Hours of Service are billed as an hourly service and are recorded in our project management system which you will have direct access to throughout the length of your project. Purchases towards our Prepaid Hours of Service are non-refundable whether in full or partially under any circumstance after billable time has already been recorded. 
11. Acceptance
 
Your purchase of prepaid hours of service indicates acceptance of these terms & conditions.
